In our latest Anders Denken Podcast, Susanne Meijers, employment law attorney and entrepreneur, discusses various issues within employment law and regulations in her second visit to the podcast.

Several topics will be discussed, including the possible changes in the area of flex work and the ambiguities that are currently the legislation of this, when is someone really self-employed?

Meijers also discusses the legislation surrounding the non-competition clause: "There seems to be more case law suggesting that a non-competition clause is not intended to hold on to your employee and is insufficient to make someone abide by the non-competition clause purely for this reason."

The rules around monitoring personal e-mail at work come up, when is this allowed? "The best thing an employer can do is to put rules about this in the company rules, so the employee is aware of them. Privacy wise, the employer is not allowed to just do this.""You have to have a purpose for checking that email."

Suzanne Meijers also discusses the bill on mandatory confidants, "The bill that is before us will make it mandatory for companies with 10 employees or more to have a confidant and the idea is that the working conditions of the employees should be good and that establishing a confidant can contribute to that. Especially in the current times with situations like borderline behavior, you can imagine that it's a good idea to establish a confidential advisor."
